1. Agreement to Terms

These Terms of Use (“Terms”) are a legally binding agreement between you (“User”, “you”, or “your”) and Dynamic Vision Works (“we”, “us”, or “our”), the developer of ThaliFit — an Indian nutrition and wellness mobile application available on iOS and Android (“the App”), and the associated website at thalifit.com (“the Website”).

By downloading, installing, or using the App, or by accessing the Website, you confirm that you:

Are at least 18 years of age

Have read and agree to these Terms and our Privacy Policy

Have read and acknowledge our Health Disclaimer

If you do not agree to these Terms, you must not use the App or Website.

2. Eligibility

ThaliFit is intended for users aged 18 and above. By using the App, you represent and warrant that you are 18 or older. We do not knowingly permit users under 18 to register or use the App. If we become aware that a user is under 18, we will terminate their account and delete their data.

3. Account Registration

3.1 To use ThaliFit, you must create an account using a valid phone number (via OTP) or a Google account.

3.2 You agree to provide accurate, complete, and current information during registration and onboarding (including age, height, weight, and health goals).

3.3 You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.

3.4 You must notify us immediately at privacy@thalifit.com if you suspect any unauthorised access to your account.

3.5 We reserve the right to suspend or terminate your account if any information you provide is found to be inaccurate, false, or misleading.

4. Permitted Use

You may use ThaliFit solely for personal, non-commercial wellness and nutrition tracking purposes. You agree not to:

Use the App or Website for any unlawful purpose

Attempt to gain unauthorised access to any part of the App or its backend systems

Reverse-engineer, decompile, or disassemble the App

Scrape, extract, or systematically collect data from the App or Website

Impersonate any person or entity

Submit false, misleading, or harmful content

Use the App to build a competing product or service

Interfere with the App’s infrastructure, servers, or networks

5. Health & Medical Disclaimer
5.1 Not Medical Advice

ThaliFit is a nutrition tracking and fitness guidance tool. It is NOT a medical device and must NOT be used as a substitute for professional medical advice, diagnosis, or treatment.

5.2 Consult a Professional

Before starting any new diet or exercise programme, consult a qualified healthcare professional, particularly if you have pre-existing medical conditions, are pregnant or nursing, are taking prescription medications, or have a history of eating disorders.

5.3 No Guarantees

We make no guarantees regarding the accuracy of calorie or nutritional data, weight loss or fitness goal achievement, health outcomes, or suitability for your individual circumstances.

5.4 AI-Generated Content

Features including photo-based food logging, menu scanning, meal plan generation, and recipe creation use artificial intelligence. AI output may contain errors or inaccuracies. Always verify information and apply your own judgment.

5.5 Emergencies

Do not use ThaliFit in a medical emergency. Call your local emergency services immediately.

5.6 Nutrition Data Sources

Calorie and macronutrient data is sourced from the Indian Nutrient Databank (INDB) and the USDA database. Actual nutrition values may vary based on preparation method, ingredient quality, and portion size. Data should be used as a guide, not an exact measurement.

6. App Features & Acceptable Use
6.1 Food Logging

You may log meals via photo, manual search, or Build Meal. You are responsible for selecting accurate portion sizes and food items.

6.2 Photo Upload

Photos submitted for AI food analysis are processed solely for dish identification and are not stored on our servers after analysis. Do not submit photos that contain other people without their consent, or any inappropriate content.

6.3 Menu Scanning

Uploading a restaurant menu (photo or PDF) for analysis is permitted for personal use only. Do not upload proprietary documents you are not authorised to share.

6.4 Health Integrations

Connecting Apple Health (iOS) or Google Health Connect (Android) is optional. By connecting these services, you authorise ThaliFit to read step count and calorie data. You can revoke this access at any time from your device settings.

6.5 Notifications

By enabling notifications, you consent to receive meal reminders, streak alerts, and other in-app notifications. You can manage or disable notifications at any time in App settings or your device settings.

7. Intellectual Property

7.1 All content within the App and Website — including but not limited to text, graphics, logos, UI design, data models, food database compilations, AI prompts, and software code — is the exclusive property of Dynamic Vision Works or its licensors and is protected by copyright, trademark, and other intellectual property laws.

7.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

7.3 Nothing in these Terms transfers any ownership of intellectual property to you.

7.4 “ThaliFit” and associated logos are trademarks of Dynamic Vision Works. You may not use our trademarks without prior written permission.

8. User-Generated Content

8.1 Any content you submit to the App (food log notes, exercise notes, etc.) remains your property. By submitting such content, you grant Dynamic Vision Works a limited licence to process and store it solely to deliver the ThaliFit service.

8.2 You represent that any content you submit does not infringe any third-party rights and complies with applicable law.

9. Third-Party Services

The App integrates with the following third-party services. Your use of these integrations is subject to their respective terms and privacy policies:

Google Firebase: Authentication, cloud database, notifications, analytics

Google Sign-In: Optional account authentication

OpenAI: AI food analysis and meal plan generation (server-side only)

Apple Health: Optional step and calorie data (iOS)

Google Health Connect: Optional step and calorie data (Android)

Expo / EAS: App delivery and over-the-air updates

We are not responsible for the availability, accuracy, or practices of these third-party services.

10. Subscriptions & Payments
10.1 Subscription Plans

ThaliFit offers the following subscription plans:

Monthly Subscription: Billed on a recurring monthly basis at the price displayed at the time of purchase.

Yearly Subscription: Billed on a recurring annual basis at the price displayed at the time of purchase.

Current pricing is displayed on the applicable app store listing. Prices may vary by region and are subject to change with prior notice.

10.2 Free Trial

New users are eligible for a 3-day free trial of the full ThaliFit experience. The free trial is available once per user and cannot be combined with other offers. At the end of the 3-day trial period, your subscription will automatically convert to the selected paid plan unless you cancel before the trial expires. You will not be charged during the trial period.

10.3 Billing & Renewal

All subscriptions are processed and billed through the Apple App Store (iOS) or Google Play Store (Android). Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours before the current period ends. Your app store account will be charged for renewal within 24 hours prior to the end of the current period at the applicable subscription rate.

10.4 Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to premium features until that date. No partial refunds are provided for unused portions of a billing period.

10.5 Refunds

Refund requests are handled by the applicable app store in accordance with their refund policies. Dynamic Vision Works does not process payments or refunds directly. For refund inquiries, please contact Apple Support or Google Play Support.

11. Disclaimers & Limitation of Liability
11.1 “As Is” Service

The App and Website are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

11.2 Service Availability

We do not guarantee uninterrupted or error-free operation of the App. We may modify, suspend, or discontinue any feature or the entire App at any time with or without notice.

11.3 Limitation of Liability

To the maximum extent permitted by applicable law, Dynamic Vision Works shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App or Website, including any health outcomes, data loss, or decisions made based on App content.

11.4 Cap on Liability

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim (or ₹1,000 if you have not made any payment).

12. Indemnification

You agree to indemnify, defend, and hold harmless Dynamic Vision Works, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the App or Website; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any content you submit to the App.

13. Account Termination
13.1 By You

You may delete your account at any time via My Account > Delete My Account Permanently. This permanently erases all your personal data from our servers within 30 days.

13.2 By Us

We may suspend or terminate your account immediately, without notice, if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law.

13.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Sections 7, 10, 11, 12, and 15 survive termination.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through an in-app notice and/or a message to your registered phone number at least 14 days before the change takes effect. Continued use of the App after the effective date constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and may delete your account.

15. Governing Law & Dispute Resolution
15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Sultanate of Oman, without regard to its conflict of law provisions.

15.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Muscat, Oman.

15.3 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us at privacy@thalifit.com and attempt to resolve the dispute informally within 30 days.

15.4 DPDP Act (India)

Indian users may raise unresolved grievances with the Data Protection Board of India as provided under the Digital Personal Data Protection Act 2023.

16. General
16.1 Entire Agreement

These Terms, together with the Privacy Policy and Health Disclaimer, constitute the entire agreement between you and Dynamic Vision Works regarding the App and Website.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right.

16.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights to a successor in connection with a merger, acquisition, or sale of assets.

16.5 Language

These Terms are drafted in English. In the event of any conflict between a translated version and the English version, the English version shall prevail.
